Terms of sale and licence

1. Who you are contracting with
Moligon (“we”) publishes the software offered on this site. Buying an app or commissioning custom work means you accept these terms.
2. The licence you receive
A purchase grants you a non-exclusive, non-transferable, perpetual licence to use the app for your own purposes, personal or commercial, on the number of machines stated on that app’s page. The licence covers the major version you bought and every point release within it.
You may not resell, sublicense, rent out or redistribute the software, nor publish its licence keys. You may not decompile or reverse engineer it except where local law says that restriction cannot be enforced.
3. Activation
Apps validate their licence key over the internet on first run and periodically afterwards. If you replace a machine, deactivate the old one from within the app or write to support@moligon.com and it will be reset.
4. Payment and refunds
Prices are in US dollars and exclude any tax your jurisdiction adds at checkout. Refunds are governed by the refund policy, which forms part of these terms.
5. Trading software: no advice, no guarantee
Software sold here that relates to trading is a record-keeping, analysis or execution tool. It is not investment advice, it is not a recommendation to enter any position, and nothing on this site should be read as a claim that any tool will be profitable.
Trading futures, options and other leveraged instruments carries substantial risk of loss and is not suitable for every investor. Past performance, whether simulated or actual, does not indicate future results. Decisions you make with the help of this software remain entirely your own, and you are responsible for verifying that any automated behaviour does what you intend before you run it on a live account.
6. Warranty
The software is provided as is. We warrant that it will substantially perform as its product page describes, and defects reported within the refund window will be fixed or the purchase refunded. Beyond that, no warranty of merchantability or fitness for a particular purpose is given, to the extent local law allows that exclusion.
7. Limitation of liability
Our total liability arising from the software or these terms is limited to what you paid for the licence in question. We are not liable for lost profits, lost trading opportunities, lost or corrupted data, or any indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded.
8. Custom development
Commissioned work is governed by the written quote and scope agreed before the deposit is taken. Where that document and these terms conflict, that document wins.
9. Trademarks
NinjaTrader® is a registered trademark of NinjaTrader Group, LLC. Moligon is not affiliated with, endorsed by or sponsored by NinjaTrader Group, LLC. Windows is a trademark of Microsoft Corporation; macOS is a trademark of Apple Inc. Those names are used only to say what the software runs on.
10. Changes
These terms may change for future purchases. The version in force when you bought is the version that governs your purchase.
