Terms of sale and licence

1. Who you are contracting with

Moligon is a trading name of ANSO Capital LLC, a limited liability company registered in the United States (“we”). It publishes the software offered on this site. Buying an app or commissioning custom work means you accept these terms.

The contract is formed when payment is taken, is written in English, and is governed by the laws of the Commonwealth of Massachusetts. Any dispute arising under it is heard in the state or federal courts sitting in Massachusetts.

For any question about these terms, a purchase, or a licence, write to support@moligon.com or use the contact page. Correspondence is answered by the person who wrote the software, usually within two business days.

2. The licence you receive

A purchase grants you a non-exclusive, non-transferable, perpetual licence to use the app for your own purposes, personal or commercial, on the number of machines stated on that app’s page. The licence covers the major version you bought and every point release within it.

You may not resell, sublicense, rent out or redistribute the software, nor publish its licence keys. You may not decompile or reverse engineer it except where local law says that restriction cannot be enforced.

3. Activation and the one-machine limit

Your licence is a file signed by us. The app verifies it with a public key built into the program, on your machine, without contacting a server. An install therefore keeps working whatever happens to this website, or to us.

The file is bound to one computer, and the software enforces that. One purchase, one machine. Reinstalling Windows, or the application itself, on the same computer does not require a new file.

To move to a different computer, request a replacement file on the activation page. There is no limit on how many times you may do that. The condition is that you stop using the software on the machine you moved away from. Because an issued file is offline and signed, we cannot disable one once it is out: the limit on how many machines you use at a time is a term of this licence, backed by our declining further replacements, rather than by a remote switch. Each app also states on its own page what it does, and the support page describes the transfer in plain terms.

The version of the Trade Journal for NinjaTrader 8 sold today makes no network calls at all. It does not validate a licence over the internet and does not check for updates. A later version may validate through a third-party activation service, such as the one NinjaTrader operates for its vendors; if one does, it will say so on its product page before you buy it, and the version you already bought keeps behaving as it does now — a perpetual licence is not revised underneath you by a release you did not install.

4. Payment and refunds

Prices are in US dollars and exclude any tax your jurisdiction adds at checkout. Payment is taken by Stripe or by PayPal, whichever you choose; their terms govern the payment itself, and these terms govern what you then own.

Refunds are governed by the refund policy, which forms part of these terms.

5. Trading software: no advice, no guarantee

Software sold here that relates to trading is a record-keeping, analysis or execution tool. It is not investment advice, it is not a recommendation to enter any position, and nothing on this site should be read as a claim that any tool will be profitable.

Trading futures, options and other leveraged instruments carries substantial risk of loss and is not suitable for every investor. Past performance, whether simulated or actual, does not indicate future results. Decisions you make with the help of this software remain entirely your own, and you are responsible for verifying that any automated behaviour does what you intend before you run it on a live account.

6. Warranty

The software is provided as is. We warrant that it will substantially perform as its product page describes, and defects reported within the refund window will be fixed or the purchase refunded. Beyond that, no warranty of merchantability or fitness for a particular purpose is given, to the extent local law allows that exclusion.

7. Limitation of liability

Our total liability arising from the software or these terms is limited to what you paid for the licence in question. We are not liable for lost profits, lost trading opportunities, lost or corrupted data, or any indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded.

8. Custom development

Commissioned work is governed by the written quote and scope agreed before the deposit is taken. Where that document and these terms conflict, that document wins.

9. Trademarks

NinjaTrader® is a registered trademark of NinjaTrader Group, LLC. Moligon is not affiliated with, endorsed by or sponsored by NinjaTrader Group, LLC. Windows is a trademark of Microsoft Corporation; macOS is a trademark of Apple Inc. Those names are used only to say what the software runs on.

10. Changes

These terms may change for future purchases. The version in force when you bought is the version that governs your purchase.
